METHODS OF PERSONAL DATA PROCESSING – RECIPIENTS
The processing of your personal data is carried out, pursuant to art. 4 paragraph 2 of the G.D.P.R., through collection, recording, organization, structuring, storage, adaptation or modification, extraction,
consultation, use, communication by transmission, dissemination or any other form of making available, comparison or interconnection, limitation, cancellation or destruction.
Pre-contractual phase: The personal data provided by you through contact via email at info@simplextechnology.it will be processed by our employees, expressly authorized to process. Navigation data is not visible to the Controller. All information thus collected is used solely and exclusively for corporate use.
Contractual phase:
Your billing data will be entered into the accounting management system (“MAP”) of Simplex srl, and therefore on its server. Only a specific authorized person will have access to such data, with special credentials, not visible to any other subject.
Newsletter:
Personal data relating to the processing of the periodic newsletter will be viewed only by the internal authorized personnel of Simplex.
Recipients:
They may be accessible for the aforementioned purposes to employees or internal collaborators – specifically authorized by the Controller – as well as to third parties who collaborate in various capacities with the Company to fulfill obligations arising from the law or from the contract stipulated with the data controller, such as: web hoster, e-mail hoster, system administrator, management software assistance company, accountant, law firms, banks.
The data provided will not be subject to profiling.
The data provided will not be subject to extra-EU transfer.
PURPOSE OF PROCESSING AND LEGAL BASIS.
Your personal data will be processed, pursuant to articles 6-7 GDPR, for the purpose of:
1. complying with the Company’s communication needs, including any transmission by e-mail to your e-mail address of any information you have requested (pre-contractual negotiations);
2. fulfilling the Company’s tax/accounting obligations (contractual phase);
3. communicating such data to the Public Security Authority, or the Judicial Authority, should such a request be notified to the Company;
4. for promotional purposes of Simplex Technology srl (so-called “newsletter”), based on the consent you may have given.
The legal basis is, therefore, a Union regulation.
MANDATORY NATURE OF DATA PROVISION
All data provided by you to the Controller – referred to in the paragraph “Common data provided voluntarily” are necessary for the execution of pre-contractual negotiations / execution of the contract. Failure to provide such data will make it impossible to provide you with the requested information / finalize the contract.
NEWSLETTER – CONSENSO
Only in the event of your express consent, given via the form on the website, or by filling out a paper form at a trade fair event, will Simplex Technology srl send you a promotional or communication newsletter, on a monthly basis, regarding the Company’s offers, or products of third parties of which Simplex is an authorized reseller. You will have the right to unsubscribe from this newsletter simply by clicking on the cancellation formula at the bottom of the aforementioned e-mail, at any time and free of charge. Such revocation will not invalidate the consent previously given.
DATA RETENTION PERIOD
The Data Controller will process your personal data for the time necessary for the aforementioned purposes and, in any case, will delete your data within 24 months, if in that period you have not become our customer. Billing data of customers/suppliers will not be kept for more than 10 years, calculated from the moment of the last contract stipulated by the Company.
RIGHTS OF THE DATA SUBJECT
In your capacity as a data subject, pursuant to articles 15 – 22 and 77 of the GDPR, you have the following rights:
- ACCESS: to obtain confirmation of the existence or otherwise of the same data, to know its content and origin;
- RECTIFICATION: to verify its accuracy and, if incorrect, to request rectification, or, if modified, integration or updating;
- CANCELLAZIONE: to request the cancellation, transformation into anonymous form, blocking of data (the so-called “right to be forgotten”);
- LIMITATION: to request the limitation of processing, if the data subject: a) contests the accuracy of personal data, b) identifies illicit processing, c) data is necessary for the purposes of proceedings before the Judicial Authority, d) the data subject has opposed the processing;
- PORTABILITY’: to receive, in a machine-readable format, the personal data provided to a Data Controller and to be able to transmit it to another Controller without hindrance;
- OPPOSITION: to object to the processing of one’s data for particular reasons;
- NOT BE SUBJECT TO AUTOMATED PROCESSING: to object to automatic processing of one’s data, including profiling;
- COMPLAINT: to lodge a complaint, for violation of personal data, before a Supervisory Authority.
